Virginia man charged with DUI manslaughter

The Virginia State Police reported that a single-vehicle crash in Caroline County during the early morning hours of Nov. 1 claimed the life of a 29-year-old man. The man was the passenger in a Dodge pickup truck that left the roadway. The 27-year-old driver of the pickup truck faces a raft of charges including counts of driving while under the influence of alcohol, being a felon in possession of a firearm and DUI manslaughter.

According to a VSP report, the pickup truck was proceeding northbound on Mount Vernon Church Road at approximately 12:53 a.m. when its driver lost control as he entered a turn. Police say the vehicle ran off the roadway, struck some trees and then overturned. Emergency response workers pronounced the pickup truck's passenger dead at the scene. Police say that he died after being ejected from the vehicle. The truck's driver was treated at the scene before being taken into custody. Accident reports suggest that neither man was restrained by a seat belt at the time of the crash.

Police at the scene determined that the pickup truck's driver was impaired by alcohol. However, initial reports do not reveal the results of any toxicology tests that may have been performed. After being detained at the scene, the driver was charged and transported to the Pamunkey Regional Jail in Hanover County.

Criminal cases in Virginia involving felony charges linked to fatal accidents are sometimes more complex than they seem. When presented with facts like these, experienced criminal defense attorneys may study police reports and accident investigations closely to determine the cause of the crash. When factors other than intoxication, such as poor road conditions, a missing street sign or treacherous weather conditions, may be the direct cause of an accident, attorneys might seek to have DUI manslaughter charges dropped or dismissed.
