Man sentenced after authorities find drugs in his home

On March 22, it was reported that a Virginia man was sentenced to prison on charges that included possession with intent to distribute cocaine, heroin and marijuana. He had pleaded guilty to the charges on March 14 though he was actually taken into custody in 2014.

On May 21, 2014, potential drug activity was reported to the authorities. When officers arrived at the home, which was located in the 700 block of Hayes Avenue, they found a group of people outside. The accused man, age 34, began to walk away when an officer reportedly smelled marijuana and asked him to stop. He was eventually detained and searched, during which authorities found drugs and other items, like a GPS monitor with a dead battery, in the man's pockets.

During the subsequent home search, authorities found drugs and drug packaging materials in addition to marijuana. A woman with two children were also found to be living in the home. She was facing other charges as a result, though her case was dismissed after she agreed to cooperate with authorities. The man was ultimately sentenced to 33 years and eight months in prison, though nine of those years were suspended.

Being charged with marijuana possession with intent to distribute can lead to serious legal consequences, such as a lengthy jail sentence. A criminal defense attorney may seek to have the charges dismissed if there is evidence that the search and seizure conducted by the authorities was illegal, meaning the evidence could be thrown out of court. If the person does not have prior convictions, the attorney may get the case dropped if the defendant cooperates with the authorities.
